Here are some of my thoughts in response:
1) If the 3rd Amendment was void and the firms were allowed to re-capitalize, wouldn't that limit or reduce the US Treasury's role is backstopping them in the future?
2) Is the US Treasury invincible to law or our constitution simply because it provides a means for the GSEs to be profitable?
3) Should all companies that the US Treasury supports such as banks then be treated in the same regard as Fannie / Freddie? I.e, maybe hostile take over of banks by US Treasury? Maybe US Treasury should sweep all Wells Fargo, BAC, Chase profits because less people would put their deposits in banks without FDIC insurance.
