Ganz, if this is a bluff, it backfired big time. An effective bluff would have seen AUPH's share price hold nearly steady. The fact that it has dropped so far as a result of the "bluff" gives the buyer far more ammunition for their position.

It's pretty clear to me that management doesn't give a damn about shareholders. Keep you eyes peeled for Class Action suits.

I may be wrong, but most often those who make estimated tax payments do so based on the previous years tax liability. The IRS won't charge a penalty if you pay at least 100% of the tax liability of your previous years tax (making estd payments in 2022 based on 2021 tax) or if you pay at least 90% of your current years tax(2022).
ex. Your 2021 tax liability is $25,000 and your 2022 tax liability ends up being $30,000. In order to escape penalties and interest, you would need to have paid estimated taxes of 100% of the previous years $25,000 or, if you're brave enough to venture an educated guess, you'd need to have paid in 80% of the 2022 liability or $24.000.
Most choose the 100% route as it's much easier to calculate.
So, a capital gain put off until January 2022 would most certainly delay your payment of taxes.

For me, I bought 50 (5000 shares) $32 DEC Calls and sold 50 DEC $45 calls. Tried for more today, but the spread ran away from me.
Also picked up 10 $30 NOV Calls.

Zeppo, the way I read Micham's statement, "I think it is highly unlikely that AUPH and a large pharma have struck a deal, but have agreed to delay announcement for some reason" is much different than your interpretation, "You offered an interesting premise that there is no pending acquisition via big pharma."
I may be reading more into it than it deserves, but I like his take on it better.

Maybe we get a PR pre market on Wednesday. That's my prediction. Friendly deal (attractive price), both companies agree to keep quiet until then.

I agree with you and Jess, however AUPH must be getting a boatload of phone calls. It seems to me that they would be unable to even answer the phone or would be getting sick and tired of saying "no comment."
They likely have many longtime, loyal investors who want more than that and the only legal way to respond would be a press release. (plus I want one)

I'm surprised that AUPH hasn't issued any kind of press release. Whether they deny the rumor, suggest that a deal is only in preliminary talks or suggest they have no interest in selling. Something.
I'm not a lawyer by any means, but I would think their silence opens them up to class action suits.
Perhaps if they remain silent the stock exchange will contact them for clarification.

From what I have read here, the approval is supposed to come on January 22. If people invested in JAN 15 options they were a bit foolish.
I'm guessing, but I think run ups into events are starting later than they did in the past. So many potential homeruns in biotech that people are a little greedier than usual. They don't want to tie up money I guess.

In my opinion biotech investors are looking at opportunities that may materialize in the next couple of weeks. So much is happening with the COVID issue and the companies with announcements of tests, vaccines, therapeutics, etc.
We will see activity as we get much closer to the real news for AUPH.
