Holmes and Schena were of the Silicon Valley mentality "fake it until you make it"
But they got caught, and are paying the price. So are the investors who believed them and fell for the scam. Don't expect the restitution to be paid.

But Nielsen had pled guilty. Not Mark. The jury found Mark guilty, so there are sentencing guidelines.

And restitution of $1,196.51. What a joke!

Criminal Charges: On April 18, 2022, Jason Nielsen was charged with one count of securities fraud for his involvement in a scheme to induce investors to purchase securities using deceptive and manipulative means. Nielsen was a large investor in Arrayit, a publicly traded medical technology company based in Sunnyvale, California, who frequently posted on public message boards about Arrayit under the name “PennyStockAlert”. According to the criminal information, beginning in or around 2019 and continuing through in or around 2020, Nielsen communicated and posted materially false and misleading information about Arrayit, the existence of genuine supply and demand for Arrayit securities, and the nature of his personal financial stake in Arrayit securities, all in order to fraudulently induce other investors to purchase Arrayit securities and thereby drive up the stock’s price, all while Nielsen simultaneously and secretly was selling his own previously acquired shares at an artificially inflated price. The purpose of the scheme was for Nielsen to enrich himself at the expense of other investors.

I find it interesting that the SEC sued and settled with the Arrayit Corporation and Rene

The SEC separately sued Mark, and that case is pending the final resolution of the DOJ case against Mark.
The SEC wants to ban Mark from ever serving as an officer of a public company and for him to pay a penalty.

The DOJ sued Mark alone, not Arrayit

My question was can people go after the corporation itself for crimes committed by Mark.

Nobody in their right mind would want Mark and Rene running the company.
Rene has been banned and Mark will soon be in jail for a long time.

But what happens to the corporation? Can it be run by other people?

I'm just curious.

The USA vs Mark Schena case and his conviction does not include Arrayit as a defendant.
I don't think people can go after Arrayit for restitution, can they?

The class action suit against filed by McGowan against Arrayit and Pinnertest was settled on Nov 21, 2021
I guess that's why Pinnertest is selling their products again.

The lawsuit file by Arrayit's landlord Dollinger for nonpayment of rent is still active.

I remember that Taub , Zalcberg and others contributed $1 million or so to fund the ovarian cancer test, but then Arrayit used the money to build the new lab instead.
The DOJ said the lab was just for show.

You're welcome. Dorothy Atkins is very busy this morning at the San Jose Courtroom covering Schena's jury deliberations and Elizabeth Holmes who is also at the same Courtroom today for a hearing.
Both cases have the same judge. At some point he had to take a 30 min break from Holmes hearing to answer questions that the Schena hearing had.
