Healthier Choices Management Corp. Files Patent Infringement Lawsuit Against Philip Morris

Healthier Choices Management Corp. (OTC Pink: HCMC) today announced the filing of its patent infringement lawsuit against Philip Morris USA, Inc. and Philip Morris Products S.A. in connection with their product known and marketed as "IQOS." The lawsuit was filed in the United States District Court For the Northern District Of Georgia.
The international law firm Cozen O'Connor has been engaged to represent HCMC in this matter.
HCMC's lawsuit includes claims that Phillip Morris is infringing HCMC's patent rights in connection with IQOS, an alternative tobacco product marketed and sold by Phillip Morris. Philip Morris claims that it is currently approaching 14 million users of its IQOS product and has reportedly invested over $3 billion in their smokeless tobacco products. Philip Morris has been very open about their ongoing transition from traditional fully combustible cigarettes to their modified risk tobacco products, including IQOS.
The Philip Morris IQOS product is currently the subject of two other patent infringement proceedings filed by RJ Reynolds Tobacco Company. One proceeding is before the International Trade Commission and seeks to stop the importation of the IQOS product into the United States; the other is a patent infringement action currently pending in the Eastern District of Virginia. RJ Reynolds' patents are unrelated and not affiliated with the patents asserted in the HCMC case.
"We are pleased that after a lengthy and careful analysis, a law firm with the patent litigation reputation and strength of Cozen O'Connor will be enforcing our patent rights," said Jeff Holman, CEO of HCMC.
Mr. Holman concluded, "We look forward to proving our allegations of infringement in this matter and intend to continue to move forward against any and all companies that infringe upon our intellectual property in both the tobacco and cannabis categories."

Good morning! TGIF!
From Mike - Just spoke to Nurse Jonathan. He says Delinda is doing “good” this morning. She is eating breakfast. She seems fairly comfortable though a little out of breath. They continue to watch her ABGs, which are currently good. They have started to drop the ECMO settings again. ECMO is currently @ 30% with a sweep of 2.0. I don’t think they are quite ready to go back to the cannula yet and they change among various kinds of masks depending on activities to deliver supplemental O2. They continue breathing treatments and are giving her steroids to help as well. They are adamant about weaning off ECMO and have been concerned about the issues with her nose. They have mentioned the possibility of a tracheotomy if necessary to allow them to continue but we are not there yet.
I am thankful for the hands-on care she continues to receive from her medical professionals at Methodist.
I continue to pray for healing. I prefer that comes without more invasive actions but I place it all a God’s feet.
I thank you each for your concern for Delinda and your prayers on her behalf.

Update on Delinda Aviptadil was approved again.
From Mike - Spoke to Nurse Chino this morning. Delinda hasn’t been really comfortable over the last couple of days. She had a nose bleed that started some time over the weekend. Cannula in he nose, continuous O2 flow irritates the tissue and blood thinners make it worse. Yesterday that had decreased her ECMO sweep to 1.0, but then had to pack her nose and therefore change from a cannula to a breathing mask. She then felt a little short of breath. I would have too! Nose is still packed to ensure bleeding stops. Decreased blood thinner slightly to help. Still on mask to prevent further irritation and deliver O2 despite packed nostril. Brought sweep back up to 1.5. All in an effort to tweak support down but keep her safe and comfortable.
ECMO still at 21% doesn’t go lower. Sweep at 1.5. O2 saturation still okay. Will do ABGs later to see if they can reduce sweep again.
They will begin the next round of Aviptadil in about an hour.
I am thankful that Dr. Youssef is willing to continue using Aviptadil to try to improve Delinda’s condition and that the FDA approved it. I am thankful for the improvement it has brought so far. I pray that it continues to help. I pray that the extraneous issues that are tormenting Delinda right now and leaving her so tired will clear and let her heal in peace.

Good morning, Warriors!
From Mike - Just spoke to Nurse Mary. Delinda is doing well this morning. She had some stomach issues and a nose bleed yesterday that just kept her a little down but she is feeling better today. Dr. Haroon stopped by this morning and made another adjustment to ECMO. It is currently set at 21% (this is effectively the O2 concentration of room air) and the new sweep setting is 1.0. They did up her nasal cannula setting to 15 liters for comfort. Her O2 saturation is 94. Her nose is a little stuffy because of the nose bleed yesterday. I’m not sure she is getting that full 15 liters. They continue to tweak as necessary to wean her off ECMO while keeping her safe and comfortable. Dr. Haroon told Delinda she is doing well but her lungs are still not normal. She has “chronic respiratory failure “, but she can recover from that. They hope to have her off ECMO in the next couple of days. Have not yet heard the FDA’s decision regarding continuation of Aviptadil.
I pray for continued, stable progress. I also pray that Delinda is physically comfortable (her body has and is experiencing a lot of significant changes), emotionally comfortable (this is a bad time of year to be in the hospital) and spiritually comfortable (look how far God and the skills of her medical professionals have brought her). Also praying for a favorable FDA decision.
Heavenly Father, we know you hear our prayers. We continue to ask you for Delinda’s complete healing and comfort in the mean time. Keep her spirits lifted during this holiday season. We also pray you will guide the FDA to the best treatment options for our friend. Keep her medical team safe and healthy. In your name we pray, Amen! ????

Tommy Update I know this morning’s update is very different than previous and some stuff most won’t understand but we just wanted to share with you all everything we were told today....
Vent on 70%
ECMO on 30% can’t take off yet due to drop in O2
ABG
PaO2: 91
PaCO2: 36
pH: 7.14
Bicarb: 12
CBC
White blood cells: 60.2
Lactic acid: 12.3
BMP
everything out of range. Potassium is very high and liver enzymes off the charts.
Developed pneumothorax overnight and put chest tube in left side but did not help much.
Ultrasound on liver...thought there was something there but one radiologist said no. They’re asking for 2nd opinion. Some thoughts were gallbladder or
Ischemic liver.
X-rays of belly has been ordered.
Blood pressure very low especially on arterial line. He’s on 3 meds for it and a 4th has been ordered.
Nurse said it’s not good and he’s struggling to live.
