There ARE NO FACTS showing Jay is being dishonest. I believe the judge is doing a very thorough job in this case. The Fischer's on the other hand, are doing a great job of destroying themselves. Once again, you are entertaining only yourself with your crude comments of someone you know so little about. We are in for a big surprise...and a couple of pals on here will be very disappointed.

Of course the judge issued a fraud trial. He was forced to. When one party aledges fraud then the judge must have a trial to investigate and have the facts be proven. He states that in his reading. Does this mean that JTR is guilty. Of course not. So please, stop trying to be the judge and jury. Your "facts" are very misleading. The over and over of saying the same bullish things are getting very stale.
Bottom line, the Fischers have tried so many times to make a claim on these emeralds with no positive result. Is this the last straw? A fraud trial? Can't dig to much deeper than that in my opinion. And there witnesses? Some real stars there. We are all in for a big surprise and I do believe a couple of posters on here will not be happy. Jay's slate is clean to this point...nothing out there that PROVES otherwise..the Fischer's slate on the other hand...NOT SO CLEAN.

Went ahead and bought back in again...about 4m which is twice the shares I had before. Looking to add some more as this goes up. I am convinced that EXPU will rise to pennyland within a few months if not weeks. I would, however, like to know how things are doing on the ATM and Real Estate side of this company.
I have not been here in a couple months but do see that there has been a little news. I find it odd that a company involved in real estate and ATM machines is now pursuing bottled water. There was what seemed to be so much hype surrounding the core functions of the company and now this? Where are we at with the atm's and real estate? Any news on that? I sold my interest awhile ago with intention on getting back in. Any info on where EXPU is REALLY going would be nice. And 3rd quarter financials, where are they?

For the past week I have sincerley missed the postings by certain posters on this board. I have been waiting for an appearance by them to ask what they think of the filings by JTR as of recent. We have heard in the past that certain posters on this board believe the Fischer's to be credible, honest, and just all around good jolly people. The "gods of the treasure world" if you will.
These new filings are really calling out your statements as being false! They are stating that the Fischers are all BUT credible, honest, and good people. It seems to me that the Fischers are really the scamming, scum, bottom feeders of the treasure salvage world.
And what do we get now? Another filing of sheer BS by the Fischers side...
My predictions coincide with Spinner's in his previous post where he states that Jay will win this case and it will be over soon. I also believe that the Fischer's name will be socially bankrupt in the eyes of those watching the treasure salvage world. Destroyed.

If you are going to bash, bash with facts and get your story straight.
For someone that is not connected to this case, you sure seem to state to be very close to everyone and know then and see them on the streets and have "no problems" with them. JTR will win this case Capted, ORRV will end up a winner in this case and their endeavors. The one that you supposably financed.

I don't believe to many people out there read Capted's or X's posts anymore as they have been determined frivolous numerous times over...but that is alright as it is only their opinion. Some people in this world just get jealous when the little man wins. Then they have to throw a ton of malarkey around the lucky guy to try to discredit him.
Bottom line, who cares about a lawsuit that has been settled....who cares where people dove...
We care that the emeralds are Jay's and that they will in due time benefit ORRV. And then all of us that have shares can meet for those drinks TB mentions!

What I stated is that nobody else can pursue getting the emeralds awarded to them. ANd I did not state that there would be a PR, ORRV states that they will not comment anymore until the emeralds are no longer in litigation. Could it be today? Probably not.
THis was stated before court hearings. Nobody else can file for ownership of the gems. It is over...the barrell idea sank...your gemologist prooved to be incompetant and the Fischers dropped their case...Nobody else is out there to claim except Jay.

Some script from the 60 minutes episode is all I can place on here to answer your questions. Where the emeralds are I have no more idea than you do...I do know that the Fischers were given a chance to inspect them and did not inspect all of them. THere were many bags the Fischers expert stated that he did not inspect...perhaps he missed something? I don't know about the glue or oily substance either. THis thing is still in litigation and that is something for us to ponder and if nessacary, for the courts to find out and relay in time...

As for your statement on ORRV not being mentioned in the 60 minutes episode....that is not entirely true as they do mention investors in general accomidating Jay in his endeavors. ORRV is an investor.
I will attempt to make this easier to understand Kelel. Imagine that you are a racecar driver that runs a race for a purse of 1 million dollars. You are worth 0. You come to me and ask for $52,100 (5.21%) so you can enter this race. I show interest and invest...
You win the next 5 races...my investment just grew for me 5 times because I own 5.21% of your race-team. You are now worth millions.
Now CBS Sports wants to do an interview with you about your racing...Are they going to mention me the investor personaly? No, the talk is going to be on the races you have won and your cinderella story.
The same is true for this case Kelel. Its only on a lot bigger scale as we are talking 60 Minutes and the largest emerald find to date.
Please get your facts and put just a little thought into what you say before you say it. The bashing of ORRV and Jay is widely done on this board with absolutely no factual basis. I will not deny that their may be some skelatons lying in some closets somewhere..find them, back them up on a factual basis, and then do your bashing.

This PR is also available for you to read on the ORRV website. It used to be posted above in the stickies but someone removed it and replaced it with information about someone selling their shares.
Pay special attention to the part that states that ORRV currently owns 5.21% of JTR Enterprises. It also states that ORRV is confirms involvement in the discovery of the emeralds.
Also pay attention to the ending statement where Scott states that ORRV will not make anymore statements until the case is resolved.

Originally aired on Sunday, April 22, 2012, the 60 Minutes episode examines the recovery of over 65,000 Colombian emeralds by Jay Miscovich of Latrobe, Pennsylvania. Said 60 Minutes, “Last year, we got wind of a story that seemed — on the surface — too good to be true. An amateur diver and part-time treasure hunter had made one of the largest discoveries of sunken treasure in history: a sea bed covered in raw emeralds off the coast of Key West, Florida.”
Scott Heimdal assisted Mr. Miscovich and his company with early stage project management and financing on this project. In exchange for those contributions ORRV currently owns 5.21% of JTR Enterprises.
“Only now that 60 Minutes has aired the program are we able to reveal details of our involvement to the public.” said Scott Heimdal, Chief Operating Officer of ORRV, “We expect a favorable ruling, however, due to the ongoing proceedings in Federal Court ORRV will be making no further official statements until the case is resolved.”
Hook line sinker? It is obvious you have no idea what is really going on here. Please go back and read the last PR that came out after the 60 minutes episode. Scott states that ORRV has involvement in the emeralds discovered. He also states that the emeralds are in litigation and that he would update us as soon as the emeralds are awarded to whomever they belong too. As of now they are still in litigation. Perhaps he is keeping his word and staying out of something that they don't belong in. These are Jay's emeralds and do not belong to ORRV. Scott is probably doing the right thing in not dragging his company into the legal mess that has risen as the result of the gems.
Be it greed by the Fischer's or not; it is blatently obvious (to an outsider) that they have had no business in ever pursuing this little mission of claiming the emeralds. As soon as one idea is turned down, they come forth with something new...Is this the judges fault and can he put an end to it? My opinion is NO. The judge is bound by legal obligations to uphold the law and allow for appeals no matter how ridiculous they may seem to us; to play out. Am I irritated with that? Yes...I would love to be able to cash in my shares for a huge profit tomorrow. Do I believe it will come? I believe it has a better chance than picking up a Powerball Ticket and hoping late Saturday night that the stars alighn in my favor. And yes, I would love to see this make ME and YOU money. And if one posts that we are greedy and only here for the money; they would probably be correct. Someone without a financial interest here is probably only here for one thing...DRAMA. To bash and play games with false claims.
So Hook Line Sinker this..I will put my lotto ticket money into a company that has nothing..no boat, no crew, and possibly no money. I do this because of their invovement in the emerald discovery and their small percentage that has the possibility of making my life better through my investment. And I will take the side of my investment throughout litigation. However, I believe in ORRV for other reasons.
Scott was a kidnapped and held for ransom while exploring his passion for treasure hunting. He was strong enough to make it through this and to continue his hobby and create a business out of it. Someone that passionate about something is not going to let a few hiccups get in the way of their dreams. He will find a way to get the money needed to make his company succeed. Why? Because then he succeeds. I want this for Scott. I want it in a selfish way. Because this will make me money too.

Go ORRV this week. Just have a feeling it is going to be big this week and the trip zeros will be gone. Maybe we will see news from ORRV or an answer to the Fischer's alegations that the stones are only worth 50K. They are definately worth more than 50K. A lot of money has been poured into the court costs (though Jay should get his $ back) to have these things only worth 50K. Not only that Jay has experts from high end jewlers stating that they are worth much more. As one poster reported, experts were registered and the Fischer's was not. I don't understand why the judge denied the dismissal? Anyone got anything on this?
Count, First off, I have a good feeling that the dinner that Spinner refers to will not be held so therefore you can keep the hot sauce or perhaps share it with the Fischers. Looks to me like the fines, penalties, and withering of the Fischer's name will be about all the crowe they can handle.
Unsure of what crimes you really speak of as the oil could have been placed on the emeralds by anyone. I do like the interesting word you throw in with illegal..ethics.
It seems highly unethical for the Fischers to chase after something that isn't theirs to begin with. To say "boo-hoo, someone else found something in this ocean and its just not fair" sounds not only unethical but childish. The story the Fischers tried to get the courts to believe were found false. Then they bring in a felon, Gerry Ed as a star witness. This Ed was convicted of numerous crimes including incest. How does this all look for the Fischer's name? Who would MOST (besides yourself and Capted) lean towards being the criminal in this case?
The emeralds are worth way more than $50,000..and ORRV will get their percentage. How much? I have no idea but hope it comes soon for the sake of many on this board who have stuck behind Jay and ORRV for so long. Those of you that doubt the value of the treasure really need to go back and watch the 60 minutes episode where many professionals were hired to estimate a value. Not someone bias toward the Fischers.

I see this as another tactic by the Fischers to discredit Jay with slander. Anyone that has not seen the 60 minutes episode needs to watch as there is video of the emeralds being inspected at a high end jewler in New York City and they state that the emeralds are of high value. These emeralds were more than likely inspected and priced more than once prior to The Fischer's gemologist. We must remember that the person writing the report is bias to the Fischer party.
There must be numerous investors out there that were obviously of extreme wealth in order to fund this endeavor for Jay. These wealthy men are not going to invest unless they know they have a good chance of getting their money back. Step one for all these investors would be to prove the authanticity of the gems.
I forsee a lot of selling and a plummet on this stock today due to more false allegations by the Fischer party. Just more for Jay to possibly use for a suit and to get all legal fees paid for. Please do sell cheap...your loss is my gain. I will continue to add shares.
This sounds like good news that the emeralds will be reviewed by both sides. Will this be the end of this long and drawn out case? Who knows...I'm sure captain Ed might have some input on this? As far as the Kent guy going on the stand and testifying...doesn't look like that will happen. Word on the plains of Nebraska is that nobody even knew where to find this guy anyway. Count, doesn't look like you we need a reserved seat for this case...sounds to me like captain Ed and his Fischer friends are going to be very disappointed and ORRV will be in headlines with NASA! If the prosecutors are putting the convicted felon on the stand to prove a case against them, would that not be a case of putting an innocent man on the stand and proving them guilty? Hence the saying innocent until proven guilty. Just asking for my curiosity.
Getting back to the case at hand, would the Fischers or Jays side be able to draw credibility out of a witness that had been convicted of murder...or maybe rape...or burglary? Just seems to me that this witness's credibility would be discredited immediately? Just my opinion. Nothing more.
I am not close to the case and cannot state whether or not Jay is worried or not. What would he have to be worried about? You state that Jay's team has not received the entire discovery...would this not be withholding evidence.
It is my personal opinion that the emeralds belong to Jay and that the Fischers are greedy. It is also my opinion that you are not as close to the case as you lead to be but are rather disgruntled over this whole situation. May I ask why if this is the case?
Also, we should not have to wait until the trial to find out the witnesses. The list of witnesses needs to be turned in long before the trial so big sides can prepare for examination. I am not wondering about the other witnesses. I only wonder what it is that you may have to offer legitimately to this case if anything.

Will you be testifying at the trial? Are you that close to the case? Also you state that Jay has not seen the entire discovery and will not be happy. This indicates that you know more than the people involoved. Out of curiosity, what is your personal interest in this case? Also, do you know if they allow convicted felons to testify? It doesn't seem right that their testiomony would be worth anything on the stand.

CIVIL TRIALS
In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury shall be otherwise re–examined in any Court of the United States, than according to the rules of the common law.
Never mind....a jury trial it can be. The good news is that it cannot be challenged again in any other court.
A jury trial would mean criminal charges...correct? I do not believe there is jury trial in civil court. I'm asking as this is just what I think...any answer would be appreciated.
The question is, how does the Fischer's examining the emeralds shed any light on who they belong too. As another poster states, there were several of shipwrecks in that area from the same era. Anyone of those ships could have been carrying the emeralds. Who is to say that they would not be from the same mine?
The Fischer's do not have a lot going for them in my opinion. First they come up with the idea that the emeralds floated away in a barrell. That didn't fly so now we have this idea of the emeralds being stolen. There was never a police report filed and I am willing to bet the "stolen" emeralds are not even insured. Give me 500 million dollars worth of emeralds and I will have them insured.
In order for someone to have something stolen, one must first have posession of the items. Simpley put, if the Fischer's were to win this case, I could walk up to someone holding a $100.00 bill and claim that they stole it from me. No, I never had it in my possession but Jon Doe at a bar stated that it was mine.
And to the poster that states that this claim by the Fischer's is not based on greed; what is it then? Because there sure isn't any supportive evidence or facts on the Fischer's side. Jay found the emeralds...that's a fact. He has or had them in his possession...that's a fact. The Fischer's are greedy...that is my opinion.
All of this is my opinion...until someone can prove otherwise, I will continue to believe it.
Suppose someone steals your tool box full of tools from your garage. The first thing that you do is call the police and file a police report. (and then probably the insurance company) The police find the suspect and the district/county attorney file charges based upon the evidence gathered from the police. The suspect goes to CRIMINAL COURT and the judge or a jury of his peers decide his fate. (unless a plea bargain is made prior)
However, suspect is able to bring up the fact that you had originally attempted to get this tool box in CIVIL COURT when one day he was in your garage and noticed that your tool box had mysteriously rolled from his garage to yours. It "floated away".
Does the above story sound a little ridiculous looking at it from a smaller scale?

$500 million worth of emeralds would be insured one would think. Can the Fischer's produce a list of what they have insured and any statements to the insurance company of missing emeralds?
Has there been any investigation by FBI or anyone else? Not yet.
The case is completley bogus....Hearsay does not hold up in criminal court. Give it up Fischer's and stop Fishing. Go bring up your majestic Atocha and maybe along the way you will find several gems lying on the bottom of the ocean floor. I can only hope that someone contests you for them.
