Hey, realized the full plans were sitting at the SEC when I looked them up. Obviously would not have gotten notifications of filings since the ticker is delisted. Second plan pretty clearly states, at least to me, that we are slated to get no property or interest in the reorganized Rotech. This one hurt the most because had a ton...way to much...locked up in it. But, the bottom line, you were right on the money about the way this would go and I have to eat crow. Emailed back and fourth with JT a little and he still thinks the shares he holds will go somewhere. After reading the final plan that is accepted I highly doubt it. It is what it is. Such is life in the real world.

Schwab reported it as bankrupt/shares cancelled. I took the deduction on my 2013 taxes. It was listed as total loss on my 1099.

Really? Wow, ok. Ameritrade it is totally gone...showing as a loss. So, it still shows the number of shares with a status beside it as regoranizing? I think, IMHO, that it is a good sign that some of the brokerages still show it in some sort of transition and not totally written off. Shows there is hope of some sort of finality on it which has not been concluded yet.

I must be honest, I have pretty much given up and abandoned any hope. This one just got way too strange, way too fast and I doubt we will ever know what went on in the courtroom or the executive suite. Because of Alsene's actions not passing the "smell test" before and after exit from BK, I lost any interest in the reorganized company if it ever goes private again.

Good luck to you. This was, if nothing else, a fascinating case to follow, despite the outcome to date.

Seems like, based on my reading of the docket entries as we have gone along, that they have left a crack in the door on this one open to changing the plan for reorganization at a future date if they decide to. Did you not interpret this the same way also Yank? Looked to me like there was still a small chance of it maybe converting to a sale if Barclays was successful in marketing Rotech and it was in the best interest of the company, debtors, and shareholders. Did you not see this same potential and the door being kinda of mysteriously left open for this as a possability? If not related to this, what IYHO Yank do you think the sealed info in the docket is all about? Not like even if we had some revelation at this point anyone could buy the stock anyway..=-) Just wondering if you saw the same potential and your thoughts...not doom or gloom...just your honest thoughts in a nice polite way.

Asstene OUT, sister wives fighting for position in a dying company. The investors blindsided him - PERFECT. A little different then the CLO she took the hit. He walks with $$$$$$$. CFO ready to bow out and the company heading to sell off. New interim in town. It's like watching Wall Street with moron offshore India and Mexican back-fires and lots of questions needing answered. Boy, talk about flying under the radar! It's just like a bank robbery or big jewel heist... after the theft, the criminals go into hiding and bury the loot until it is safe to come out and spend it!

I am just reporting whats going on. Actually, most people agree here that this is about 95% chance of being a goner barring a miracle which would be sheer luck. So no need to beat a dead horse.

If you read docket #1338, I see no reason to celebrate. The hearing is scheduled for 12/20. Rotech's objection makes zero sense except another greed-grab for money at someone else's expense.

Does it really matter? The judge has ruled. The only further outcomes I can see are criminal prosecutions, if a whistleblower is willing to come forward... which I seriously doubt.

Wonder if this will go anywhere? Interesting part is, shouldnt this be huge considering the implications of this on the case and the fairness towards the equity holders? This is the firm that advised the equity committee on what to do and fought their case? If they were also working behind the scenes with the creditors, shouldnt this be a huge issue and maybe even reason for the trustee to petition the court to put a halt to the entire BK untill this can be sorted out? Seems like waiving some law fees is not close to enough and they should have another non-conflicted firm look over the entire case and the depositions on behalf of the equity holders before proceeding. This is also true considering that if the ACA is repealed in the future there is a ton to gain here owning Rotech.

My Schwab statement now shows all shares cancelled and the transaction as a total loss. I think that's it, guys. Instead of singing, the fat lady simply passed away in her sleep like Mama Cass, choking on a ham sandwich that was ordered up by Arthur Reimers, made by Rebecca Myers and served up by Steven Alsene.

Nice! The rich keep getting richer by stealing from shareholders that believe the rubbish spread by lying Gypsy creeps, IMO.

The only thing really spinning before the court is a $400K bill submitted by Berenson & Co. LLC for the valuation study done for the equity committee. The trustee has challenged the expense's necessity, completeness and cost per billable hour. I don't see anything else relevant to simply winding down the process of BK.

It's just nickel an dime stuff.

Unfortunately, there is no assurance that we will ever have that "Aha moment" and get let in on all the secrets behind the mysteries of Rotech's reorganization and sacrifice of shareholders equity. Awhile back, investor2004 and I were comparing Rotech's antics to another bizarre case in Arcadia Healthcare that sold off its assets, closed its doors and all its management and B-o-D quit, leaving a vacant corporate shell with around $33M in debt, no functioning businesses and no employees. Yet, Arcadia never filed for BK or cancelled shares which continue to trade in subpennyland at some worthless valuation. They just quit filing SEC doc's and went dark.
