I agree, they did well. They may not have done nearly as well if they had gone to court. Lets remember though that the back in rights are only for a portion of the property. It is not 25% of the total project. It is good news though.
TNR Did Really Good! They got their rights back to one of the worlds largest copper deposits, Smelter percentages,Back in rights and 1 Million shares of MUX to pay for attorney fees ect.etc. The Rest will be a great holding for them.
The stock was halted today so theirs some kind of heavy action going on.

Los Azules Copper Property Lawsuit Against McEwen Mining Settled TNR's 25% Right To Back-In At Feasibility Restored
Nov 12, 2012 (ACCESSWIRE-TNW via COMTEX) -- Vancouver B.C.: TNR Gold Corp. ("the Company") is very pleased to announce that TNR Gold Corp. and its wholly owned subsidiary, Solitario Argentina S.A. (together, "TNR") have reached a settlement with McEwen Mining Inc. which resolves the outstanding litigation with respect to the Los Azules Copper Project located in San Juan Province, Argentina ("Los Azules").
The settlement restores a 25% back-in right to TNR which is exercisable following the completion of a feasibility study. The back-in right allows TNR to back-in for 25% of the northern part of the Los Azules property, which McEwen Mining has said contains the largest share of the known resource at Los Azules.
In addition, TNR receives an industry standard Net Smelter Royalty of 0.6% and 1 million shares in McEwen Mining (information about McEwen Mining can be found at http://www.mcewenmining.com and on Sedar at http://www.sedar.com ). The Net Smelter Royalty is over the northern portion of the property and is triggered if TNR chooses to back-in for 5% or less or is diluted below 5%. In return, TNR will discontinue its claims and transfer to McEwen Mining the mineral rights to a property called Escorpio IV.

We have listened to the Conference Call with Rob McEwen and have understood that even "investment professionals" are not reading McEwen Mining SEC 10-Qs any more. As you know, we were pointing out during the years that Minera Andes and, later, McEwen Mining should disclose more Information Related to the Los Azules Litigation for the benefit of all shareholders involved.
It was done by now by McEwen Mining and on a number of different levels, in SEC 10-Q reporting, in May Conference Call and in a number of presentations. You just need to read it.
Concern of the Mcewen Mining shareholders is well understood - there is not enough money to fund El Galo Stage Two even after this Rights Offering. As you remember, before 200 million Shelf Prospectus was announced - so there is more to come. It is so far for the Dream of MUX in S&P 500 by 2015 - as it seems now.
We do not know why, but the out of the court settlement on Los Azules has not happen this time before the Trial. Last time Rob McEwen was able to settle even with "partner from hell" - Hoschild mining.
The Los Azules Trial TNR Gold vs. McEwen Mining and Xstrata subsidiaries will start on November 19th, 2012 and we will follow it closely. Whatever the "outcome from the court by end of Q2 2013" (RM -S.) there will be the appeals from all parties involved, so unfortunately, Los Azules will not be properly monetised any time soon, unless McEwen Mining will accept a huge discount and contingent liability subject to the litigation and appeals' final outcome. There is always a possibility that the McEwen Mining or The Third Party will bid again for TNR Gold, but it does not look like they are selling The Farm now, after the announced Shotgun Gold discovery in progress.

50% discount price of the Rights Offering puzzles us as well, why 15-20% was not enough? Is it the case that even McEwen Mining can not get financing on the better terms now or there is something else? Rob McEwen with his largest holding in the company of 25% will benefit the most increasing his position by number of new MUX shares at this level, but It Is Not Prohibited By Law and he has invited everybody, who can afford, to participate proportionally to their holdings. Price action after November 8th will be one to watch now.

(RM tries to comment - muted... - S. - they are supposed to drill only on "NON Contested Properties" as per NR in June 2012) Even if you are putting funds to the good use, am I correct that you can not take those funds out of Argentina?
Rob McEwen: I think a lot of companies are nervous to take a lot of money out of the country... But the assets are there, they are producing. I have taken some comfort once they have changed the rules understanding that they are losing tax revenue."

"Will dividends from 49% San Jose be sufficient from cover McEwen Mining's exploration & development expenses in Argentina?
Mr McEwen has repeatedly said that the motivation for merging Minera Andes & McEwen Mining was to internally fund the development of El Gallo. However, as I had pointed out previously, such as goal was completely unrealistic even if there were no issues with removing USD from Argentina. The roughly $10m per quarter dividend from 49% San Jose would only be sufficient to fund explorations expenses and corporate G&A. Now the question turns to is the proceeds from 49% San Jose sufficient to fund the exploration & development operations in Argentina? According to Hochschild Mining's interm conference call, the San Jose mine (aka Minera Santa Cruz - MSC) does not expect to accumulate excess cash within Argentina for the remainder of 2012 and will primarily use cash-flow-from-operations to fund development at San Jose and pay-down short-term debt which stood at $25m to $35m at the end of 2Q2012.
Now we see disclosed in the recent prospectus for the Rights Offering within the section "USE OF PROCEEDS" that a portion ($5m) of the $60m proceeds will be used to fund exploration at Los Azules in Argentina. In other works, management at McEwen Mining also has doubts whether the San Jose mine will be distributing enough excess cash to internally fund operations in Argentina. So much for trying to take USD out of Argentina because it looks like we will be bring fresh new USD into the country.
According the recent McEwen Mining conference call we should hear news next week regarding how much Q3 dividends were distributed from San Jose (Minera Santa Cruz) to our Argentina subsidiary, Minera Andes SA.

I wish good luck to TNR. I will win if they win, but I do not expect that they will win. As a matter of fact, I will win either way. I have already hugely discounted Argentina in both positions. Argentine mining may become more lucrative in the future, but I expect things to get worse before they get better. I am content with N.America at the present time.

LOL, not on my account. i would never buy for "shins and grins" Dont buy unless you like it. I have no desire to influence anybody to buy just because I like. Both positions in my mind are excellent. This one in my mind is less discovered. One recent hole was close to 100K ounces here per my calculation. One is producing. (a huge plus). I prefer producers. The producing is also approx 40 times the PPS. It is all a balancing game. I prefer producing companies, but exploration showing huge potential is worth much more then 1/40 IMHO

Gosh, we cant be pro both?? That is silly. TNR will lose the law suit. No matter, Argentina is POS because of legislature right now anyway. Both have positives and negatives. Balancing, both are more positive than neg. I am sure that stating that I believe TNR will lose the court case wont make me popular here. So what. They will lose (IMHO) and speaking the truth does no harm. They have other excellent prospects from what I see and I see anything in Argentina as a sink hole for $. I AM PRO MUX ALSO. HAVE BEEN FOR about 1.70 worth.

That is not exactly the best place in the world to be it seems. I do like the shotgun property though. I did pick up a few shares and will be watching closely for the opportunity to pick up some more in my area of comfort.
