NLST Parts from MIL Ord sec—OTHER ISSUES
"Smsng’s counsel expressed concern over Ntlst’s intent to call Smsng-affiliated witnesses"—"Court denies the former relief requested, as the Court finds sufficient Netlist’s identification of the relevant subjects about which Smsng witnesses will testify in its case"
"Smsng contended that Ntlst should not be allowed to prove a breach should Smsng convince the jury of its interpretation of JDLA§6.2."—"Court disagrees with Smsng. Ntlst’s pleadings, discovery responses, and motion papers do not foreclose it from presenting a breach case upon the theory of the contract Smsng intends to proffer at trial. This is especially true given the several interpretations of §6.2 Smsng offered over the course of its defense of this case."
"Court also rejects Smsng’s argument, apparently made for the first time at the conference, that the Court should allow it to revive its affirmative defenses if Ntlst is allowed to bring a breach case on Smsng’s interpretation"

The Recap not working and preventing me from making docs publicly available is really messing with my abilities to share and explain things/filings. Any input/ideas that can help would be appreciated.
I have an Apple IMAC running older OS Monterey—which worked fine till Recap update—though initially it also didn't work for about a month, then magically did.
I guess I can always post a bunch of screenshots of each page—this instance would be about 20 per doc, but that's hard for folks to read, and ideally it's best to use the link to the actual documents.
Another thing I'd like to do is figure out how to make video/audio with screen share, but without having a Youtube channel.
I will keep trying though, and hope it starts working after a bit of time, like when I initially started using it.
NLST BOC case Motions In Limine & Final Pretrial Orders were filed. Since updating Recap Ext it hasn't worked... paid for doc and can access, but can't make it public—I'll keep trying. If I knew how to post video without Youtube, I'd love to show & walk folks through the complex docs.
Netlist mostly got what they wanted on KEY issues, with stipulations for Samsung otherwise... which is pretty good considering what Samsung tried. Must read to understand, or let it play out.
Parties to confer on final verdict form version.
MILs Conclusion—"Court grants in part and denies in part Netlist’s 4th MIL, grants in part and denies in part Samsung’s 5th MIL, and denies all the other MILs subject to the guidance in this Order."
Pretrial Conf Order contents & few facts:
-4 day trial
-Netlist Claims & Defenses with Statement
-Samsung Statement on Netlist Claims and Defenses
-Samsung Counterclaims & Affirmative Defenses—none plead/raised
-Remaining Triable Issues—Netlist & Samsung positions
-No Bifurcation

I like getting into stocks that may take years to get back to breakeven that is funny as real is real, only we know how to do that lol !!!!! oh the memories..........
one that comes to mind.........nlst baby, i been waitin longer than i have on any play in my entire career. right now i'm down about 30cents pps so i still got plenty of hope !!!!
looks like it about ready to fly you are welcome.
Right now, I really just want a NLST payout that is above breakeven.. 3 years is a long wait at 74. My wife wants to do some slow travel for three months (plus) through Europe or where ever we can afford and that takes lots of money.
And thanks for UVIX. Almost got it at the all time low of 7.31 but I took to long looking at past history and it jumped to 7.39 where I pushed the button. Make us Happy.
you are correct but I think I'm ready for the big payout,
The good thing about holding NLST is that every month that passes by, a portion of my shares turn to Long Term capital gains for lower taxes when we finally do get that million dollar payout!!!!
I like getting into stocks that may take years to get back to breakeven like NLST lol good point.
It's OK, gdog. I like getting into stocks that may take years to get back to breakeven like NLST, SOFI, and a few others. 🤣😂 it was only for 100 shares at 1.02, then .86, then .73. As that old saying goes: Hurry up and wait!
sorry I bought to soon on allr myself the second time .98 I bought the first time at 1.00 and it went to 1.34 then rebought when it retraced to .98 now .76 so I'll hold for awhile as it looks to be truning back up g/l
lets face it, when this does move they will get buried !
oh i believe it, your not the only one seeing it. and as far as the wine and cheese goes, your on your own !! lol !!! not exactly, but its too hot here to complain.........
I know but after 5.5 yrs or maybe 6 I'm just getting very tired of seeing them be able to do it.. suks
They will manipulate it as long as they can, but when it takes off they don’t want to be covering short positions. Let’s go.
the manipulation here is unbelievable, and its the mm's that are doing it imho . they are buying up all the shares they can in anticipation of the move when the 14th comes
probably wrong about all that lol just so tired of seeing a stock never go anywhere. now can ya lend me some cheese and crackers to go along with my whine? lol

$NLST netlist increased sales of the company's products by 120%. Many people wonder why margins are low, perhaps one reason comes from the fact that 4 million nlst sales could show losses (it's one of the tempting hypotheses).
I add, netlist has finished products worth $13 million, up from $7.5 million in December. There's definitely something interesting behind it.

$NLST I know how it feels wanting to know what’s going on in the courtroom in California. I don’t think it would be a good thing to have a reporter in the courtroom unless that person can report accurately what takes place. It could lead to more anxiety than being helpful! There are many things that happen with the fast pace of the lawyers that could be interpreted the wrong way. When I am in that situation I only report what I am 100% sure is correct and will be verified in the document drops. I don’t know if anyone will be in Judge Scarsi court the 14th but if so I hope they can report accurately what happens, and will be able to rebut any fuds that are there! I will be at the Micron trial on the 20th and will only report information that is 100% accurate as I have in the past. The Micron trial is fast approaching!Good luck true longs !
$NLST BOC conf/hearing Minutes dropped—text only entry. Full read in screenshot.
"Court and counsel confer about the proposed verdict form. The Court will allow each side seven hours to present their case-in-chief. Counsel address the Court on their motions in limine. The Court takes Plaintiff's MIL to Preclude Evidence or Argument Covered by Estoppel, MIL to Exclude Evidence Regarding Abandoned or Rejected Defenses, MIL to Admit Testimony, MIL to Exclude Evidence Regarding Jury's Finding of No Cover Damages, MIL to Exclude Evidence Regarding Post-Termination Sales, Defendant's MIL to Exclude Testimony of Scott Milton, Devon Park, and Noel Whitley, MIL to Exclude Opinion Testimony of Netlist Expert Mr. Larry Tedesco, MIL to Exclude Evidence of Self-Serving Uncommunicated Subjective Intent and Understandings, MIL to Exclude Evidence of Alleged Consequential Damages, MIL to Exclude Regarding the Value of Netlist's Patents Licensed to Samsung, UNDER SUBMISSION and a ruling will be issued"

Wishful thinking on my part on the extra 10, just like wishing this was an extra $10 per share. Enjoy your evening.
Number 60 and no I didn't get him I have other pictures of him younger but never saw him in season. There new ones to play everyday so when NLST plays off you can join in on some of them. I hope things start happening here soon I'm so tired of the wait lol
keep in touch.
Hopefully that's deer #70 in your picture.
All good here. Just trying to avoid insane comments like the one five down from this one. I do wish I had something extra for some of your winners, but it is all stuck here.
believe it or not its all ours but it aint happening tomorrow!!!
Well with the big guns coming on board it definitely feels like a very important point of any and all ongoing proceedings. Root root root for the A team to bring this winner home!

$NLST Netlist attorney additions for appeals—Bios linked in my recent posts on them:
Michael Heim—former USPTO patent examiner.
Jonathan Lindsay—focus on PTAB & appeals.
Blair Silver—in top 2% with PTAB & CAFC appeals.
Philip Warrick—USPTO assoc solicitor / USPTO IP counsel detail to Senators / represented USPTO & Director in Fed Court & CAFC appeals.
APPEALS—in addition to Sheasby:
339—Blair Silver—#24-1707
506—Jonathan Lindsay—#24-1521
314—?—#24-1313
523—Philip Warrick—#23-2133
060/160 Director Review rqst—Blair Silver—CAFC appeal next.
215/417 IPRs—Michael Heim
As more appeals are filed I expect these names and other possible additions for Netlist’s appeal efforts. We are stacked with top talent and our winning infringement case attorney Sheasby will lead jury verdict appeals of infringers along with some of these names.
CAFC appeals is where it matters and where the money/damages are made and patent validity/invalidity is affirmed... and we have a winning team to bring it all home.

$NLST No minutes or orders have been filed from BOC pretrial conference yet. Regardless of what the parties argued for and how they argued... I’m ok with letting them work out issues without diving into the weeds. Mostly interested in the judge’s decisions on pretrial matters and how the trial plays out.
At this point and considering all the pending aspects relying on the outcome, in addition to what we’ve been through on the BOC matter, we just want the result... the rest is trivial. As informative and interesting everything else can be, as it pertains to this case/issue—BOC—only the verdict will suffice for me.
Keep in mind that Netlist can appeal if the judgment/verdict/outcome is adverse. Not sure how much desire there is to watch Samsung attempt to manipulate and misrepresent every aspect to the jury—which will be hard to tolerate and swallow, causing severe frustration—which I don’t plan on entertaining. Perhaps going off the grid till conclusion seems like a wise choice.
Well, fine. I already said I could be mistaken. But - my opinion is that your posts have been thinly veiled in the negative, for the most part. Here is the gist of them:
WRONG!! I have said nothing negative about the company just the timeline to reach the end goal and the PTAB’s invalidated rubber stamp and not wanting to see that negativity highlighted in some chart.
We all already know they will pay huge damages, the question is when???
anyone hold UBS I sold three days ago up $2.00 since

$NLST the market already discounted every single bad news, let’s remember when ptab said no to 912.
We are ready for every single opportunity right now, let’s see the boc and micron trials in the next weeks.
Let’s destroy them, Samsung and micron will pay huge damages
NLST popa chubby is buying shares today, heard it on the msg boards........
My opinion is that Mr. Termonator is a fudster from over on the other board. He just barely joined, has posted on no other iHUb boards and every post has been fairly negative. Could be wrong but....sure seems like it.
Just a refresher for any newbies here.. great article from 2023

For what its worth my thoughts are the new specialists on USPTO and CAFC matters would not have signed on to fight for netlist if they thought everything was actually legit with there decisions. That leads me to hope there is no chance for samsung and micron to weasel out of all this unless they are paying judges and everybody else under the table. Interesting and exciting times ahead
I’m so dizzy my head is spinning!

$NLST To say that our special matters attorney—wrote POP/Director Review request in 912 IPR regarding Real Party in Interest issue, which was granted but later ruled not RPI—and appeal expert Phillip Warrick is connected is an understatement... and ironically, he actually represented the USPTO and its Director in court on appeal cases at the CAFC. If he’s good enough for the USPTO and its Director in cases at the CAFC, he sounds like an astounding pick to represent Netlist at the CAFC for our appeals, along with our other recent CAFC appeal and PTAB specialist hires—one of which was a USPTO patent examiner (Michael Heim) and other is in the top 2% in appeal wins at the CAFC (Blair Silver).
Link to Philip Warrick's bio/profile below — check out part of it in the screenshot...🔥!!!

Stokd $NLST **UPDATED CHART**
Few changes/developments since 4/26, also reflected Samsung/Micron appeals of PTAB validated patents—will be first CAFC appeal results we get—which should stick considering PTAB’s hindsight obviousness nonsense… safe to say if they could’ve they would’ve invalidated. I would think German case 735 patent invalidity ruling will be appealed as well, perhaps awaiting 660 decision first.
Samsung’s 523 appeal is in late stages—filed July 3/2023—and currently in the process of scheduling Oral Argmnt. Parties provided scheduling conflicts for the first week of the months July-Dec—when CAFC hears cases—Netlist available / Samsung unavailable Aug. Micron’s 314 appeal was filed Dec 29,2023.
Phillip Warrick—big gun from DC/Irell office who has assisted in special matters on certain aspects in Netlist’s litigation—is lead and will argue for Netlist on 523 appeal. I suspect he'll work other appeals with our new appeal specialists. His Bio is impressive! More in next post.

not a dumb question, but all these scumball companies are in bed together so the only time their gonna throw you under the bus is if there gonna get squashed first, and the very next day its business as usual. the ones that use the product you are supplying are the ones that will go with you as long as you can stay valid. if they can get it legally cheaper they will. some companies are crooked and some companies will pay you. sk and nlst are licensed, i hope to God they renue that contract... sorry for the ramble, i'm sleep deprived.............
Is it possible that SK wouldn't want to chip in on our cause to prevent the people from stealing what they are paying for? Dumb question but just a thought.
