It was not too long ago when all of the legal stuff started people were shouting "Case Dismissed!!!". Making fun of the postmaster and the DOJ. Stating that there was a "real" reason why they did not file their SEC documents for years and years. Gaslighting, made up PR, excuses and just about everything was thrown out there to keep that stock up. Then the bottom dropped out and I'm sure there were quite a few still holding on saying well, I've come this far so what the hell.

I'm glad the truth was exposed at trial. The real reason this all came to a head was the company was almost broke and they were using smoke and mirrors to keep everything afloat. They tried to squeeze medicare for 10K for an un/needed/wanted allergy test. They lied to get lab approvals. They boasted about a test they did not have at first, and then when the FDA deemed it unacceptable. They blew smoke to potential and existing investors. They comically said Schena was on a "short list" for the Nobel. This is not hearsay now. This is public record and by a jury of peers people were convicted of their crimes. All of these fraudulent acts have now been released by the press around the globe.

So it looks like Monday October 16th is the date for the sentence. This is where it all comes together. I'm interested in what Schena is going to tell the judge. I'm hoping it's something like "I'm sorry judge, but you don't understand. I've been doing science all my life and wanted to help people. Don't you see that our building was right next to Apple and our twitter followers were more than Proctor & Gamble?? Why must I file SEC documents that were audited when I can twitter out everything to our followers right now? Can't you see that's a much quicker solution? Don't you know that my technology is so good Big Pharma is behind all of this just to shut me down? I'll tell you what, why don't you stop by the lab and take a private tour. I'm sure that will change your mind about sending me to prison." That should add a good 3-4 years to the sentence.

We received 3 nearly identical notices from DOJ in District of Columbia in the past few days. Does anyone know whether Judge Davila will make his courtroom hearing accessible to all members of the public via video and/or audio?

Yes sir! I was bush wacked after emailing Mark and mentioned that he made a typo in his Twitter statement. Mark you accidentally posted $250 million inventory run instead of the usual $25 million inventory run. His response, " the tweet is accurate at tweeted." My fault and lack of experience to believe him. No biggie. DOJ, FBI, SEC, and the Postal Inspector have all the correspondence, and I contributed to his demise. I'll take that as we won't get anything else in terms of retribution for his web of lies. But civil suit could follow, as is often the case, but not sure anyone lost any real money here, idk. My advice to anyone that thinks Schena got railroaded is to attend the sentencing hearing to see what Davila has to say. It really took a lot of years of lies and deception to get to this point. There were plenty of people that shouted from the top of the hill how things were not right only to be gaslighted by the company and by the followers on this board. If after all this you still believe they did nothing then it's a biased opinion where you are ignoring the facts to base your own narrative. But you know what, that does not matter in the slightest bit. What does matter is the law, and what happens when your are perceived to break it. It took a long time for the SEC and then the DOJ to catch up to everything. But when they did, I'm sure they got the same story as investors on this board. We all heard here about Schena's defense and what was going to come out in trial to explain all they did. What actually came out at trial was evidence to support all of the accusations of wrong doing and witnesses to back it up. Guilty on all counts.

So everyone can dress it up how they like. The facts are in. The law was broken. There was a trial that resulted a GUILTY conviction for all counts. Schena is now a convicted felon and will be hearing his punishment in October. Then the conspirators will be hearing their fate as well.

So now that the dust has settled, and anyone still would like to support the people that got everyone/everything here that's an adult decision. Given the decisions they made as a board I must say I it would be a very risky play but to each his own. I would have zero faith that they learned any kind of a lesson and would be just trying to keep their head above water regardless of who and what they run over. But I will say this, if anyone wants to know how things end up if you decide to break the law then please attend the sentencing hearing. That will crystalize everything into a prison sentence and fines and restitution.

I'm sure the judge will ask Schena to answer to all of concerns voiced on the questionnaire. The judge will try to determine if Schena is remorseful for his crimes. Should be a pretty interesting sentencing hearing on Oct 12th.

I had a nice exchange with Justice and perhaps this third delay will be the last. No guarantee but it seems like everything has been exhausted and sentencing will be soon.

Yes they sure do, but I can't help but thinking that every day is agony awaiting the fate that will not be going away. I'm not sure of the reasoning for the delay (and I don't think Davila officially granted the request yet) but I don't think the DOJ objected to the request. Maybe he's just trying to get through the holidays and then start the prison sentence. Maybe he's just scared to hear his fate. Who knows?

It does mean all the other conspirators will have to wait as well.

One thing is for sure, it's not going away.

Arrayit and Rene Schena agreed to settle with the Commission and to be enjoined from future violations of the charged provisions. Rene Schena also agreed to a 3-year officer and director bar and to pay a $50,000 penalty.

So she could be CEO again early next year. I believe the bar is only pertaining to public companies. As telechem just filed their annual list not long ago and she is listed.

8/21: USA v. Mark Schena Sentencing. The time is drawing near. It's taken quite sometime but I'm sure it's no fun knowing that the time in prison needed to pay the debt to society awaits. I'm sure Schena will follow the Balwani/Holmes lead and appeal to the 9th Court to stay out of prison while the appeal process runs its course. That should buy him 4 more weeks out after his initial report date.

As for spending the money, the BOP does forensic accounting as I'm sure there will be penalties and restitution that get handed down as well as the time he will have to serve in prison. Now that he's in the system I'm sure they are watching every move at this point.

I'm interested in what Schena will tell the court. If he plays the "I'm a good guy that tried to do good" card I'm sure it will fall on deaf ears. To me the sentence will reflect all of the years where actual good people and investors tried to tell them that they were off course and all of the gaslighting that was given in return by them and the "Disciples" that followed regardless of what laws were broken. You can say what you want. What matters is the law, and if you break it what the jury says given the evidence presented. Dr Schena is now a convicted felon. The others conspirators are as well. The penalty for the crimes are forthcoming. The grind is now exceedingly fine.

8/21 is coming fast. Schena's fate will be handed down. I'm sure he will do the last min appeal before reporting to prison which will buy 4 more weeks out of custody. I'm sure the other conspirators will be handed their fate right after. 2024 will be the year of paying the debt to society. I wonder if they will be discussing penalties and restitution on 8/21 as well.

Looks like the judge in the Taub case has been taking his time. That verdict should be coming any day as well. The can has been kicked as far as it could down the road.
