My report from talking to Mike King. Sorry about the delay. Bear in mind I only have a small position in this, at much higher, so at this point I've pretty much written the money off. This play reminds me of MLXO last spring/summer when cornell was selling there. Constant ask undercutting. Takes a lot of buying to UT. Not much selling to DT. It's eerie how similar it is to me in how they are selling.

Anyway, I called him and I gotta say I was pretty surprised by what he told me. I invite you all to call as well to verify this. Basically, the company is in pretty deep trouble accordong to Mike. In fact so much so according to him that he said he used to have a position but SOLD his shares due to what is going on.

He also said if he were me, he wouldn't be buying anytime soon, which shocked me. Remember this is the IR guy saying this, though I did appreciate his honesty. He said that of course cornell is killing the company, nothing new there, that he hates cornell, and that he didn't see them letting up the selling. But what I really didn't like was he also said that the company isn't doing nearly the biz they thought they would be doing based on what they said earlier this year, not anything close to it actually, and are having a very hard time getting any additional financing. Without this money they can't make anything basically, but at the same time the demand hasn't been there either. So I asked him why didn't NXNO accept the settlement if they are so short of cash, and he really didn't have an answer for that.

I asked him about the lawsuit and when it could be settled. All he said was he really didn't know but don't expect anything anytime soon. Not good.

I came away from this conservation very discouraged, and I would say right now we are going lower based on what he is saying. As hard as that is to believe. :( Apparently they don't really have any news to report according to him, and Cornell is going to continue to sell. With that scenario, I see half a penny or so coming. Now, bear in mind this was one guys opinion. But it was the IR guy. So for him to be so down on a company he is working for. Well......

FYI If you call Mike? He may ask for your phone number. Don't give it to him. I did and have been receiving spam text messages ever since.

Blogger Jerome Armstrong Settles Stock-Touting Suit with SEC

Influential liberal blogger Jerome Armstrong, the founder of MyDD and an originator of the netroots movement, has agreed to pay $29,000 in fines and penalties to settle a 2003 SEC suit accusing him of touting a stock on Internet message boards without disclosing his financial interest in the company.

The Commission's Complaint, filed on April 14, 2003, alleged that beginning on March 6, 2000, Armstrong touted the stock of BluePoint Linux Software Corporation ("BluePoint") by posting unsubstantiated, favorable buy recommendations on the Raging Bull internet site. Armstrong posted over eighty such recommendations during the first three weeks that the stock of BluePoint was publicly traded. According to the Complaint, Armstrong praised BluePoint's investment value and encouraged investors who were experiencing trouble having their orders filled to keep trying. The Complaint further alleged that the promoters of BluePoint were secretly transferring stock in three other companies to Armstrong at prices below the then current market for those three stocks and that Armstrong made at least $20,000 by selling the shares he received from the promoters of BluePoint.

Along with business partner Markos Moulitsas, Armstrong helped spark the netroots movement, an Internet-fueled effort to elect Democrats and counter conservative success in other media. Moulitsas credits him with the inspiration to created Daily Kos.

Although the settlement states that Armstrong neither admits nor denies the SEC allegations, he made an August 2003 court filing that acknowledged posting messages on Raging Bull about BluePoint while he had a financial relationship with company insiders Michael Markow and Francois Goelo.

Armstrong's message board postings related to Bluepoint are no longer online, but there are dozens of messages on the InvestorsHub site in which he promoted a related company before a merger, never revealing he was given 25,000 shares before the deal.

An SEC filing reveals that Armstrong received the shares in a reverse merger executed by the Chinese wireless startup AccessTel, which acquired a publicly traded online mall called Shopss.Com on Dec. 18, 2000. Markow's Global Guarantee Corporation received 1.5 million shares in the AccessTel merger.

From September 2000 to March 2002, Armstrong posted 95 messages using the account myDDdotcom on AccessTel's InvestorsHub board. He predicted great potential for its technology and a big increase in price, deriding skeptics as "bashers." None of his postings mention his relationship with the company, formed by executives who created Bluepoint.

On the day of the merger, Armstrong announced on InvestorsHub that he had just bought 250 shares of the company:

Bluepoint laid off all employees in 2005 after a failed attempt to develop Linux software for the car industry. The company exists today as an empty shell hoping for a merger, stating in its 2006 annual report that its only remaining asset is $6 cash. More than 4.5 million shares of its stock are owned by the public, which reached a high of $21 during the period Armstrong was accused of touting and last sold for $0.04 cents.

AccessTel are currently worth one cent, down from around $1.25 at the time of the merger. The New Jersey company has left the wireless business and sells ladies pantyhose in Lebanon.

When allegations against Armstrong were first reported in June 2006, Moulitsas asked a private mailing list of liberal bloggers to ignore the story until it was settled:

Jerome can't talk about it now since the case is not fully closed. But once it is, he'll go on the offensive. That should be a couple of months off. ...

My request to you guys is that you ignore this for now. It would make my life easier if we can confine the story. Then, once Jerome can speak and defend himself, then I'll go on the offensive (which is when I would file any lawsuits) and anyone can pile on. If any of us blog on this right now, we fuel the story.

Under a December 2003 agreement reached with the SEC, Armstrong is prohibited from making any public statement denying the charges or suggesting the complaint is factually untrue.

Moulitsas has not made any statement regarding the settlement since news broke Wednesday. Armstrong told New York Times blogger Chris Suellentrop in an email, "It's good to see the matter finally end."

In April, Armstrong received the Paul and Sheila Wellstone Award for Political Organizing from the Twenty-First Century Democrats "for his visionary leadership in working to create the online netroots community, which has changed the face of politics forever in America by creating a mechanism for people to come together and demand accountability from their leaders."

The group has removed all references to Armstrong from its web site, including his photo and the announcement of his award, which was cached by Google July 20.

When Armstrong began MyDD.Com in 2001, the site's name stood for "My Due Diligence." In stock trading, due diligence refers to the care that should be taken to review all facts related to an investment prior to purchase.

OT: On second thoughts you should wait until further notice. Reason is that if the administrator passwords are compromized, then the users table is still wide open and can be copied again until the hole is closed.

OK, the tally is in. We are at ~35 shareholders holding 3.3M shares for approx. 80% of the 4.26M in the float.

From what I understand, the float is going to be this amount for quite while. The debt consolidation through PP's and restricted shares was, from my understanding, less than 1M in shares, but these are still restricted as well. All of AccessTel's shares will be restricted for a year from their final share structure agreements.

A PR is expected out shortly, confirming a JV that has been rumoured about quite a bit. Hopefully that will relieve any concerns folks have about the recent price drop, which is partly attributable to the whole mkt decline (which we had avoided), but also due to the lack of information from AccessTel

Actually, I don't think it is so much the lack of info, as the lack of follow through from the timetable set forth in the recent Conference Call:

I hope he is correct in saying that, and those who stick with it, live to make back their money. I am long here, and not just my PP shares either, in fact, threw another 6k shares in the pot from a good trade elsewhere, just figure, what the hay.
If they get the recission, I don't think they'll get screwed with another shitty deal. Conca has nothing to do with ATEL, his name was just put in the PR's cause he was the former CEO, just a figurehead, same with recission, he has never had a free trading share of ACII/SHPS/ATEL, neither Miller. He got just as screwed from the Israeli/Arab scam venture here as the rest did, and Markow, contrary to what the bashers say, has in fact RM'ed a number of decent companies over the past year, BLPT and SCRO for example--and I'm not talking about the price decline, that is across the board and a cheap shot, XNET is a great company and is down from $20's to .50 as well, it's the mk't, but they are solid companies, so maybe he can do it again?
I don't know, I've been assured that they'll get the shell back, but I think it's probably 50-50, maybe, hope so... if not, this sure leaves a bad taste, and not a bunch of money in my pocket as some here tend to believe, but that's their problem, no one pushed their buy button.

In fact, before I left for India, I bought 20k more shares at $1, that I wound up selling for 1/10th that, and that's just an example, I'm sure others here have been likewise screwed.

There is not a conspiracy here, just lame luck at attracting a bad apple that makes the bag rotten when near them all. Let's just hope we get some good luck coming our way soon, and that they file. I don't know who profited from this and who didn't, but I also don't know of anyone who pumped lies intentionally on these threads, in fact I know that no one I know did... in ATEL, most probably so, but not from the original shareholders.

If you want to fault the messenger for posting Stuarts lies and believeing them in passing them on, I think that's a little like saying I or any other long here in the beginning pumped this by posting the PR's that were put out.

Did Liang get a call from Lee or what? Seemed a bit of a retraction there in that PR. Lee get served with some bit of heat?

Some might ask why we should sue both parties - Here's why:

Both Markow and Bockler are responsible for the inside war ruining the company.
Further grounds for suing may be added by the ones, who previously stood by either side and who will now take part against the parties.

Both must be placed in a position where they are not able to further harm the company. - Distance must be made between the company and their (SB & MM) internal war.

Many things in the OTCBB world are changing - Yesterdays unregulated playground is now being significant better regulated and under much better surveilance - Thus Markow's peasants and runners might reconsider shifting to white, while it is time, and the Markow playground and towers only tremble.
