I doubt anything will come of the U.S. District Court Eastern Texas judge's review of Magistrate Payne's recommendation for SJ...the real shot comes in the federal Markman appeal...

this judge's recommendation for SJ is based on his claim construction---hopefully the feds will realize he got it wrong
