I really really appreciate your positive posts. You give hope and encouragement to most of us here.

However, in you post, first bold part you missed the "not" part which changes the whole meaning of the sentence. You decide yourself:

".......First it’s clear to me that this debtor has been investigated to death and I’m sure that even the most experienced and talented examiner that the UST could appoint would not “find any stone unturned.” ............."

Basically the judge is saying that WAMU is investigated by a lot of parties and the EC can use that information AND also use Rule 2004 to do any investigations they need.

The judge also said that "..........I don’t think it is fair to the creditors in this case, to be saddled with the costs of an investigation into systemic problems that would only benefit future parties, but not benefit the parties in this case........"

Some of you posted that the judge has a game plan for the EC so that the EC gets $$s at the settlement. I do NOT buy that. The judge is doing her job and considering all parties including the creditors. There is no secret games that she is playing for the benifit of the EC.

Another ironic think is that she mentioned several times about "litigation tactic". Rosen, JPM and FDIC played that a lot!

I am sorry but I am not positive as much as you guys about today's decision. Susman asked for the examiner and he did not get it! What is the chess game that Susman was playing about this that examiner being overruled is a good thing for the EC? How could it be?

The judge said that WAMU inestigated to death! So forget about the idea that Susman is going to find a "smoking gun"! We all know what happened to WAMU and what happened to all of us, especially preseizure holders. It is not fair! I agree 1000%

I think our only hope now is to hold shareholders meeting for the new BOD BEFORE this POR is argued and ruled (for or against) by the judge.
