Yet no one could buy their product on the open market at the time it ran. That makes it fundamentally null and void as far as investing goes.

Fundamentals refer to the company's profits and losses. Fundamentally, the company was no more sound than it is now. It ran on supply of shares available when the buyers showed up, regardless of why people bought it.

Anyone can spend one minute of their life to determine if a company is in good fundamental shape before investing. Indeed it is that persons' responsibility to weigh the risks and rewards before buying. Blaming a penny stock for promoting the unrealistic achievements is like blaming plants for converting carbon dioxide into oxygen. It's what they do.
