I agree with you...if SCOTUS refuses to hear the case, it's a huge blow because it indicates they may refuse to hear all FnF related cases.

If they refuse to hear the case, then that means that SCOTUS, Congress, and the Executive Branch all believe the same thing...and I would actually probably bail.

But I want to believe it is unlikely they will refuse to hear the case, considering that this case is knee-deep in Constitutional rights...and even addresses the rights of the Judiciary.
