They're desperate, facing massive lawsuits, losing other lawsuits, and Schena himself is accused, in court documents, of tax evasion and fraud, among other things. When they lose the lawsuits, they will be defunct, what has Schena to lose when everything is well on its way to being lost anyway? If he had any cash or worthwhile business, he wouldn't have filed false docs in 2014 and would have filed something since, maybe even settled debt along the way.
