My prior post (the one I'm replying to) was incorrect.
Thanks to Pluto, I now understand that Monday is not a hearing (with all the court room interaction implied by that). It's the last time either party can submit information to the Judge about JNJ's motion for a Summary Judgment.
My understanding of JNJ's Summary Judgment request is that, as a matter of law, DECN has no material basis for their claims against JNJ, so a trial would be a waste of the Court's time. Unfortunately, it will probably take a month or so before we learn about the Judge's decision.
I think (and Pluto seems to think) that JNJ is almost certain to lose in its attempt at further delay. If the Judge rules that DECN's case has merit, JNJ will likely be forced into settlement discussions.
DECN's suit against JNJ is for $400 - $700 million dollars.
Things are looking up.
