Just a little look into another patent case that was settled with Steven B. Pokotilow involved. However in this case he was on the defendants side, he is now representing Greenshift. This hasn't got much to do with GERS but it might give some idea about the process of mediation

Lighting Science Group Corporation v. Panor Corporation

https://www.pacermonitor.com/public/case/11275258/Lighting_Science_Group_Corporation_v_Panor_Corporation

In this case the complaint was filed on April 21, 2016
It was settled on July 19, 2016.

Interesting seems this part:

ENDORSED ORDER granting 27 Motion for Extension of Time to Answer or respond. Panor Corporation answer or response due 7/25/2016. Signed by Magistrate Judge Gregory J. Kelly on 7/13/2016.

So it seems that they had to answer before 7/25/2016
But on July 19th it already was settled and dismissing case Signed by Judge Roy B. Dalton, Jr. on 7/21/2016. That would mean IMO that the date set by the court doesn't have to mean they have to wait for that date to make a settlement public.

This might have been a very clear case.
Also other cases where filed at the same date. These took longer to settle like 'Lighting Science Group Corporation v. Globalux Lighting LLC'
This was filed also on April 21, 2016 but settled on January 24th, 2017. In that case it seems like settlement negotiations had been going on since October 2016.
