Actually, you're right, he's never "admitted" to it that I know of.

What he does is worse; he hides behind omissions on his financials, and never addresses the fact that potentially critical financial information is kept a secret. He'd rather try to act tough when someone insults him, but never seems to want to answer really pressing questions about the missing information.

Hayes is clearly scared to let investors know the truth.
