Yup. As long as it's in a phonecall he can tell you anything he wants.
This is why they have PR'S and filings.

Say "next week" in public and have it not happen and the shareholders have the SEC to protect them.

If someone isn't willing to state something publically the validity of the statement and person saying it must be questioned.

If anyone can call dan and get the same information there is no reason for them to not tell everyone the information at once.

And if the callers had integrity they would not ask questions they would tell the management to make the statement public.

After all the company doing things the way they are is only showing shareholders that their investment is not being handeled properly.
