Smart Judge. After Citizen's United, corporations now have quasi-Bill of Rights (4th amendment), rights. The judge did not want to be overturned on appeal. So, he is going to allow TAUG to make its case, no matter how pathetic.
This case is going along a typical Federal path. The judge is teeing it up for a hard nudge sometime this summer for a Magistrate settlement conference.
That being said, I think the Article III judge will grant a jury trial -- one that will never happen.
