I checked. The SEC's comment is that it does not comment on ongoing securities fraud investigations.
I know it can take 2, 3, or more years to charge the company/management.
So the investigation of the securities fraud that got AEGY suspended, demoted to the grey market, and got management to abandon the company and stop filing even unaudited financials is ongoing.
