Unfortunately, I did not download the document, but if my memory is correct, Advisorshares attorney provided the following info:
- A $400k payment was made at the time of the settlement
- A $1.3mn payment was made earlier in 2016
- A larger payment was due Jan31st of 2017 and Advisorshares was looking for investors or lenders to help make the payment
- Seemingly the largest payment is due Jan31st of 2018
Additionally, it seems that the attorney said that if Advisorshares were to default on payments to FNDM, then FNDM would have to pay $4.7mn to get the 40% it didn't already have. Whether this means FNDM does actually have the 60% of Advisorshares is far from certain, but the transcript indicated the other attorneys were surprised by this revelation in the court. If I had to guess, this was the reason the document was removed.
