A solely US-traded company cannot claim to have a 43-101 compliant report, nor can they imply they will have a 43-101 compliant report by saying they are "commissioning a 43-101 report". They can certainly do a technical report, and there is no reason (other than pure hype) to call it a 43-101 report.
