At this point none of it really matters - even if they keep the license, they'll have gone almost a year without K-cup compatibles being on the market (has anyone checked supermarkets - do they have product on the shelves?). Sales were down 41% for the reported quarter and my guess is that the next quarter will be even worse. They've mounted debt and can't pay their interest. I don't see how this company is going to be solvent by the time they make it to court.
Remember that mediation and courts take a long time to deal with things. The Marleys have deep pockets - they can afford to have a waiting game.
