Strom mentions that the 'complaint allows the Court to reasonably infer that the Clearing Firm Defendants may be liable under a theory of unjust enrichment requiring a judicial imposition of a constructive trust.'

In some cases, an imposed trust may serve as a remedy in a situation when a trustee has breached the terms of his or her duties. When an individual or business entity appointed to execute a trust is found to have become disloyal or to have stopped acting in good faith, an involuntary trust might be imposed by the court to force the rogue trustee to convey property back to the trust.

Constructive trusts are not designed to become lasting instruments. They are temporary remedies that usually conclude when the plaintiffs obtain relief. The property or assets to be transferred as a result of an involuntary trust must be specific. The court may apply a certain level of flexibility when setting the terms, which are usually not combined with restitution or other asset recovery methods ordered by the court.
