I traded some emails with Kesha over the summer
but then she stopped responding. I was hoping to get more info but have given up and thought I would share what I did find out. Following are my questions and her answers:

me: Kesha, Can you provide an update on what's going on with the Grifco case and when I might see restitution? The last notification from the DOJ on Nov 2, 2015 said an appeal had been filed by James Dial. Previous to that there was a notification on Sept 19,2015 that an appeal had been overturned, a hearing was held in August and the judge ruled that all Impact statements were to be turned over to the 5th circuit court of appeals to substantiate the amounts reflected in the restitution order. This is all very confusing to me. Can you tell me what the process is and what the current status is? It has been 10 years since my initial losses, and 5 years since I filled out the Victims Impact Statement. 2 of the 3 criminals have already been released from prison and the 3rd is probably not far behind. Those that are released and working should already be having their pay garnished and going toward the restitution fund. Please advise.

Kesha: There is no additional information regarding the appeal; however, restitution payments are still being made on this account. Because individual percentages are assigned based upon loss amounts and the fact that monies have to be divided by hundreds of victims, payments are disbursed only a few times a year so that victim accounts can accumulate the minimum disbursement amount of $50. It appears that you should have received at least $1260 to date. Let me know if you need any additional information.

me: Thanks Kesha, that helps. Is there a significant amount of money held because of the appeal, or will it continue to pay out at a rate of a few percent per year? Is it only dependent now on what they earn?

Kesha: There are no monies being held. As monies are collected, the percentages are assigned.

me: Are there any more assets to be liquidated? Or is the only thing left to be distributed, the future garnishment of wages? Two of them should be working now, and Dial should be a wage earner soon.

Kesha: no response - followed up a month later with no response. That was in September. I'll send once more.
