The patent history seems to go like this:

Optimized Data Transmission is first patented in Australia in 2006, the US in 2011, and Europe in 2012. So the method protected pre-dates 2006.

Google claims that the method is not original, at least partially, and several of the claims are based on conclusions that would have been obvious from prior work.

It does not appear that anything derived from the patents legitimately has been used commercially anywhere over the last ten years plus. (Appreciating - that Vedanti's claim is that commercially used software is infringing).
