STIPULATION
WHEREAS, plaintiff Syncora Guarantee Inc. (“Syncora”) and defendant Macquarie
Capital (USA) Inc. (“Macquarie”, and together with Syncora, the “Parties”) most recently
entered into a pretrial schedule on July 15, 2016, which was so ordered by the Court on July 15,
2016 (Doc. No. 229);
WHEREAS, the Parties seek to amend the pretrial schedule as outlined below;
NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED by and between
the undersigned attorneys for the Parties as follows:
1. Fact discovery shall be completed on December 9, 2016;
2. Expert discovery shall be completed on March 31, 2017;
3. The note of issue shall be due April 17, 2017;
4. Any opening summary judgment papers shall be filed on or before May 31, 2017;
5. Oppositions to any summary judgment motions shall be filed on or before July 19,
2017;
6. Reply summary judgment papers shall be filed on or before August 14, 2017.
7. A compliance conference will be held on December 14, 2016 at 3:00 P.M.
