That lawsuit has prevented them from finalizing their settlement agreement with Spirit Bear. The SB settlement has repeatedly been used as a reason for the company bringing their products to market. For example at one point they had 10 million in funding from Lincoln Capital that would of fully funded their commercialization of their product without the need to have taken out the multitude of toxic small convertible loans. But the SB lawsuit resulted in LC refusing to proceed with that agreement. I have been wondering whether the SB loans is holding up the any major manufactures from signing a license agreements with Cool Tech. You can imagine that if a large manufacture starts producing a product they need to be able to fully trust the contract with Cool Tech. SB lawsuit threatens to invalidate any such contract (should SB have won and demanding all sorts of $$ for their lousy, more than fully repaid and then some their loan through share conversion).
If you look at WARM's PRs they have repeatedly announced the SB lawsuit is settled, but they have done this at various points where progress was made, but the issue not fully resolved. I have been following the case and WARM has repeatedly tried to get the case tossed out. If they had succeeded then the case would of been done, but they have never got those requests approved. So they have proceeded down the longest most painful path possible. The fairness hearing is an opportunity for the final resolution.....IF.......the settlement is declared "fair". If it is not, the price will drop because they will have to re-negotiate the settlement and nothing happens fast in court. That would probably push the settlement out 3 if not 6 more months. Most of the time settlements are considered fair.
BTW, most of us long-termers (and I'm not sure how many of us are left...) think SB is a blood sucking, life depleting parasite that we would love to see go away. Same goes for Peak (who sued because they didn't like the SB settlement). The Peak further delayed progress for at over a year and counting.
