Jorge Lopehandia Defeats Chilean Government in Unprecedented Ruling

Ex-president Ricardo Lagos must Testify or his Arrest Warrant will be Triggered

September 26, 2016 - Mountainstar Gold Inc. (MSX-CSE) (“the Company”) is pleased to announce a transcendental legal decision achieved by Jorge R. Lopehandia and Juan Guillermo Torres Fuentealba in the legal case to abolish the Pascua Lama Protocol of Barrick Gold Corporation (ABX-TSX & NYSE).

In an historical and case-turning event, the Chilean Government’s Counsel for Defense of the State (“the CDE”) put forth an emergency application to try to impeach Jorge Lopehandia from calling the Ex-president of Chile, Ricardo Froilan Lagos Escobar; his Minister of Foreign Affairs, Maria Soledad Alvearand; and top executives of Barrick in Chile and Latin America to the stand to testify at the 23rd Civil Court of Santiago under case role C22.637-2015.

The Chilean Government’s legal team submitted an emergency application to delay, and try to stop, the Ex-president from declaring or being questioned, along with his Ex-minister of Foreign Affairs and co-signatory of the Pascua Lama Protocol.

The CDE argued against the legal order in Court and wished Lopehandia’s witnesses to appear between the 26th and 29th of September 2016 “indicating that Lagos had Government non- contestable privilege and, indeed, were declared by the CDE in efforts to stall the investigation, material and intellectual authors of the Pascua Lama Protocol” with full permission of the country to act as done.

Mr. Lopehandia objected to the “special privilege”, “admission of guilt”, and “syndication of material and intellectual authorship of the Pascua Lama Protocol” attributed to the Ex-president of Chile and his Foreign Minister, citing statements of two witnesses:

1. The Ex-president of Chilean’s Senate Mining Committee, who withdrew his support of the Pascua Lama Protocol, stormed out of a dinner after learning from a top Chilean executive and prominent lawyers of Barrick that Barrick Gold Corporation had prepared the document, with the co-operation of civil servants and Argentinean and Chilean politicians, years in advance.

2. Manuel Fumagalli, top Latin America executive of Barrick Gold Corporation, deposed to Fiscalia Centro Norte that “all Pascua Lama decisions are made and taken in Canada”.

An important point of the CDE submission is that the CDE acknowledged the existence of Injunction C-1912-2001. Mr. Lopehandia objected to the fact that civil servants and politicians have attributed themselves extra powers of not respecting Court decisions. The presiding judge of the 23rd Civil Court rejected the CDE application and agreed with Lopehandia.

Mr. Juan Guillermo Torres Fuentealba is seeking the attendance of a large contingent of Canadian witnesses. The CDE went so far as to falsely incriminate Ex-president Ricardo Froilan Lagos Escobar, citing special privilege and full presidential and State responsibility on the matters, to avert appearances of the witnesses. They lost the application.

THE CDE IS NOW LIABLE TO MOUNTAINSTAR AND JORGE LOPEHANDIA FOR DAMAGES. THIS IS NOT APPEALABLE.

The CDE must now defend its biased application, in a separate Chambers session of Santiago’s illustrious Court of Appeals, as to why Canadian witnesses are not needed to testify for us to arrive at the legal truth.

In closing, Mr. Lopehandia’s legal team has prepared the arrest warrants in case the witnesses decide to be in contempt of the Court Order.
