I don't doubt the claim was made before it was dismissed. Hard to figure how it could be otherwise given how time works.

The point I'm making, that you seem to be disagreeing with, is that Dimension likely won't succeed on its latest motion and that generally the counterclaim isn't going well for them.

This so called "old news" is the subject matter of the only remaining counterclaim, and the motion scheduled for October 14th.
