They admitted to not using state-of-the-art polymers and mentioned orders of magnitude improvement would be achievable by improving the design of the chemical structure.

These are testing results for their modulator design, not their chemical structures. We could use their device design if it turns out to be superior, they can't use our polymers if they turn our to be superior. I think that's the difference.
