NERG was suspended. The SEC does not often disclose that they are still investigating the fraud. If they want info from the company directly, they can send the company notice, which the company can sometimes can then disclose to investors the wider investigation.

There was obviously an investigation that led to the suspension. We just don't know if it has widened or if there is a parallel criminal investigation going on.
