1. Empire was asked where they got their data and said they got it from good old Whit Lund and Standard. That won't necessarily protect them from legal action, but if they had access to no independent source they would have a point.
2. Empire and the people who control/controlled it have more experience in the courts as defendants than Matlock did as a lawyer. I'm sure they picked up some tricks.
