jjg: Yes, the Supreme Court unanimously agreed a DNA segment, such as NK's NK, is merely "A naturally occurring DNA segment [that] is a product of nature and not patent eligible merely because it has been isolated."
However, the Supreme Court then held that if it were instead created unnaturaly, such as (cDNA), then they would be patentable.
NK has sued the USPTO for enforcing that provision and I expect they are waiting for it to go the Supremes.
What I believe is that they know they would lose under their current discovery. You can't patent a front tooth because it can now bite on Tostitos.
However, given time, if they unnaturally modify a DNA so a front tooth can slice through steel, it is patentable. The whole gamble, and it is a major gamble, is that they can, before such a ruling, prove cNK can bite through steel.
