If you make the assumption that the biggest reason the DOJ and Treasury are fighting so aggressively in court is to keep the 10,000 docs out of the public domain, then allowing the Delaware case to proceed quickly would solve their problems.

1. No production of protected docs
2. Treasury, President and Congress is off the hook for dealing with the GSEs.
3. Blame for knocking down the seizure and sweep gets blamed on “incompetent” DOJ attorneys and a “slick” former Delaware Chief Justice.
4. Frees Watt to clean up this mess, “I’m just followings court orders.”
5. The embarrassing other cases can be resolved out of court before they progress into oral public arguments.
To LEW: You have the most to lose here in addition to embarrassing the President and putting his staff and your staff in jeopardy of testifying, humiliation and possible jail time. Consider allowing Delaware a quick path to resolution.
To those who are breaking the law: Your political, DOJ and Treasury protection ends in November. Think about your future. Do you really think the next administration will protect you?
