We know that Apple will appeal. Question: When/if the VHC case reaches CAFTA will the jury decision be replaced by CAFTA judges who will substitute their personal feelings for what happened at the lower level? In other words, will CAFTA do what it’s supposed to do---determine the LEGAL questions---or will it improperly continue to sit as an independent FACT FINDER, disregarding what happened at trial, as happened to Vringo? Let’s hope the Vringo injustice doesn’t befall VHC.

A couple minor notes: Vringo had many patent office determinations in its favor, whereas VHC did not. Another difference in the cases: the VHC legal team followed the usual practice of alleging willfulness against the defendant, whereas the Vringo legal team (mistakenly, imo) did not.
