Quote:The SEC, like the DOJ, wins more than 90% of its cases, either in court or in a settlement.
Soo ... Are we discussing the same SEC ( Security Exchange Commission )
Not only is this is in a Federal Court, but The SEC lost the home court advantage when the venue was moved to NOLA.
I think The Internet disagrees with the number's presented in he argument. Note In House judges to Fed Court Judges
Quote:The SEC won against 90% of defendants before its own judges in contested cases from October 2010 through March of this year, according to the Journal analysis. That was markedly higher than the 69% success the agency obtained against defendants in federal court over the same period, based on SEC data.
The Securities and Exchange Commission is increasingly steering cases to hearings in front of the agency’s appointed administrative judges, who found in its favor in every verdict for the 12 months through September, rather than taking them to federal court.
In district court proceedings, the agency’s record is more mixed. Among cases filed that year, the S.E.C. won 7.5 out of 12, a 63 percent success rate. (The half-win represented a split decision.)
