Lanham Act and Other Competitor Actions
Lanham Act action filed in the U.S. District Court for the Central District of California by
Musclepharm Corporation (“MPC”) against PhD Fitness LLC d/b/a JYM Supplement Science,
alleging that the defendant falsely maligned MPC and MPC’s products by describing MPC as
“unscrupulous,” and alleging that it engages in “protein spiking.” The complaint further alleges that
the defendant published videos on YouTube and content on social media that deceives consumers
into thinking that MPC’s products are inferior to the defendants or of inadequate value.
