I AM an attorney, and it is absolutely the right route-- and cheaper route- to ask for a dismissal based on procedural grounds. You never argue "the merits" unless you have to, because it is always far costlier to prove all the factual matters.

Any competent attorney would file this same motion, and if HHSE and it's attorney DID NOT file this procedural motion, they would definitely be acting foolishly.

It's clear that in this industry, lawsuits are common, and settling them for the least expense involves all sorts of tactics, including filing motions to dismiss when possible. Smart move by HHSE.
