Plaintiff MyLife Recovery Centers, Inc. (herein “MyLife”), pursuant to Rule 41(a) of the
Federal Rule of Civil Procedures, notifies the Court that MyLife voluntarily dismisses the above-
captioned action against the defendants. The defendants have not answered the Complaint for
Patent Infringement (Doc. 1) or moved for summary judgment on the claim for patent
infringement asserted therein. Therefore, MyLife’s voluntary dismissal of the claim for patent
infringement is permitted by Fed. R. Civ. P. 41(a)(1)(A)(i) without a Court Order.
Also, MyLife has not previously dismissed any federal- or state-court action based on or
including the same claim. Therefore, pursuant to Fed. R. Civ. P. 41(a)(1)(B), MyLife’s dismissal
of its claim for patent infringement is without prejudice.

Definition : Dismissal without prejudice would leave the party to option to refile, and is often a response to procedural or technical problems with the filing that the party could correct when filing again.

Either the plaintiff knows that its claim was fraudulent or they want to re-file with different claims. In my opinion, Biocorx would have responded if the claims had any basis. JMO
