I believe that how the new IEEE guideline revisions are interpreted will determine if Judge Robinson will be able to have Spherix's SEPs joined in the Spherix v Cisco case. Those patents are critical to technology used in standards that allow millions, if not billions of people, businesses, and industries to communicate. I can see why Cisco and its customers are so uneasy about these issues not being settled, but at the same time they must pay a fair price for their use of same. Eventually, it will all get worked out. So, the question is, should Spherix cave the way that Rockstar did? If Nortel practically gave the patents away what does Spherix really have to lose ? Unless of course they can be penaltilized for NOT asserting the patents. Comments? AJMO and worth what you paid for it.
