The SEC CAN "touch" the US counter-parties, who made possible these sells in Europe.
If the SEC acted illegally, in violation of the securities laws, that is a crime, and prosecuting crimes IS the DOJ's business. The SEC's discretionary authority can not place them above the law, they just think it does.
