Section 83 says Joel cannot get a mining license. However, I am sure that there are plenty of locals who would front for a guy like Joel that gives him a wad of cash (or shares). All it takes is one complaint though, or if Joel reneges on his agreement with the local guy (remember what he did with Panos?) and the license could be yanked.

By the way, the environmental regulations are not spelled out in the Mining Act - just refers to this:

Forestry and environmental protection
18. (1) Before undertaking an activity or operation under a mineral right, the holder of the mineral right shall obtain the necessary approvals and permits required from the Forestry Commission and the Environmental Protection Agency for the protection of natural resources, public health and the environment.
(2) Without limiting subsection (1), a holder of a mineral right shall comply with the applicable Regulations made under this Act and any other enactment for the protection of the environment in so far as relates to exploitation of minerals.


I will have to do more research to determine exactly what the environmental rules are for placer mining in Ghana. Probably there are some reclamation rules, but not much else. Other than the use of mercury to recover the gold and fuels for pumps, etc., there are no toxic chemicals used in placer mining.
