Because he/ svfc doesn't have the patent yet for Australia. Once they get the patent then if anyone continues to use a patent process they would have to pay to use it or get sued. But until the patent is granted for that area its free basically to use because no one owns it yet.
Also the patent in Australia won't issue until the EU patent is completed. JMO
