Basically I agree with you. HTC can appeal to the Supreme Court but it will never be heard, because the only reason to appeal is going to be based on what is fair in regards to patent claim construction. The Supremes have already invited Teva to fight that issue and they won't fight it again for at least 10 to 20 years.

Even if the Supreme court requires new claim construction on appeals court cases, the new claims construction could go our way or HTC's way. Obviously if the supreme does not require new claims construction, the trial court's verdict will stand on the trial court's construction and of course we win. We may also win willfulness damages.
