If they aren't able to raise capital with the S-8, how are they able to sell the shares into the open market?

Selling shares into the open market is raising capital.
You can't have it both ways.

Either they can or can't use S-8 shares to raise capital.
If you go with can't, then your statement saying they can sell into the market is wrong.
