I may have over simplified. The third amendment has to be proven to be illegal otherwise all the "over payment" (from the original bailout) has been dividends to the gov and not capital reduction. If the third amendment stands FnF still owes the gov money. If not they have to determine how much of the over payment is interest and how much (if any) should be returned. What I'm saying is I hope they don't call the over payment interest.
