If I remember correctly the judge ordered SPEX to wait 90 days before initiating a lawsuit against Charter...we are about half way through that time period as you state if that decision was indeed 40 days ago...I believe that they will reach a settlement by the 90 day deadline...

if not...SPEX is definitely not shy about filing a lawsuit against Charter...it will be VERY hard for Charter to win a lawsuit against SPEX after the judge dismissed their pre-emptive case...they are obviously in violation of the patents so that's why they tried to "get off the hook" but it failed...now it's time to pay the piper....
