Because it isn't, it is capped at 950 million.


The Bylaws state that the AS is 5B (and that 5B being a stated value in the Articles of Incorporation is also implied in the January 29, 2010 filing, where they attempted to amend Article 6 to change the AS from 5B to 300M):



Management can talk all they want about "capping" the number of shares, but they can't change the Articles of Incorporation without a vote of the shareholders, per Oregon law, which I've proved several times before, including in this post from October, 2013.

The AS is 5B shares, per Oregon law.

MJNA management is just too scared to admit it in the filings.
